LEGAL BASIS OF THE "CAPTURE YOUR MOST Q SUNSET" DRAW

OBJECT

ANDAMAN CLASSIC SL (CIF: B90128356), with registered office at Calle Saladilla 7, 41940, Tomares, Seville, is organizing a promotional raffle on Instagram with the aim of promoting interaction and visibility of the Event Tarifa hotel.

TERRITORIAL AND TEMPORAL SCOPE

The draw will be valid in Spanish territory and will take place on the social network Instagram from March 10 until April 20 , both inclusive.

REQUIREMENTS TO PARTICIPATE

Individuals over 18 years of age, residing in Spain, who meet the following requirements may participate:

•           Follow the Instagram accounts of @qhotels_spain and @hoteleventtaifa .

•           Post a photo of a sunset taken by themselves on their Instagram profile.

•           Tag @qhotels_spain and @hoteleventtarifa in the publication (new or existing).

•           Include the hashtag #CaptureYourSunsetMoreQ .

•           Keep your account public for the duration of the contest.

•           Share the official contest post published by @hoteleventtarifa on stories mentioning both accounts (optional to increase chances of winning).

�� ONLY ONE PARTICIPATION PER FINALIST �� Each participant may only be a finalist with a single photograph. In the event that the same participant tags more than one photograph in the contest, only the image with the highest number of votes will be considered for the final phase.

DRAW MECHANICS AND SELECTION OF THE WINNER

The winner will be selected in two phases:

•           Public Vote: The five posts with the most likes will advance to the finals. The finalists will be announced on April 21 .

•           QHotels jury vote: A jury composed of the network's directors will select the winner from among the finalists.

The jury's decision will be final and will be announced on the @hoteleventtarifa Instagram account within a maximum of 5 days after the end of the draw.

PRIZE

The winner will receive one (1) night on a bed and breakfast basis at the Event Tarifa hotel. Dates available to redeem the prize: from May 5 to June 15, 2025 and from September 15 to October 9, 2025, both inclusive. The hotel night reservation will be subject to availability on the date selected by the winner. The prize is personal and non-transferable and cannot be exchanged for its value in cash or for another service. If the winner does not enjoy the prize within the indicated period, he/she will lose the right to enjoy it without the possibility of claiming it, and it will be understood that he/she expressly waives it.

WINNER NOTIFICATION AND PRIZE DELIVERY

The winner will be contacted via direct message on Instagram and must respond within a maximum of 48 hours . If no response is received within this period, the jury may choose a new winner from among the finalists. If none of the selected winners respond within the established deadlines, the prize will be voided and no claim may be made by the participants, in accordance with current regulations regarding contests and raffles.

IMAGE RIGHTS AND INTELLECTUAL PROPERTY

Participants authorize ANDAMAN CLASSIC SL to use their photograph and username on Instagram to promote the competition and future communication campaigns related to the Event Tarifa hotel. They also grant ANDAMAN CLASSIC SL the right to use, reproduce, distribute, publicly communicate and transform the images submitted to the competition in any advertising medium, digital or printed, social networks, website and other communication channels of the hotel, without time limit and without the right to financial compensation.

Participants declare under their own responsibility that they possess all intellectual property rights over the image submitted to the contest and that its use by ANDAMAN CLASSIC SL does not infringe the rights of third parties. In the event of claims, demands or legal disputes arising from the use of the image, participants expressly exempt ANDAMAN CLASSIC SL from any liability, assuming all costs, compensation or legal actions that may arise.

Likewise, participants assign their image rights to Q SENSES HOTELS SL, with address at Edificio Puerta Aljarafe, Parque Aljarafe s/n, 41940 Tomares, Seville, who may use the images in any advertising medium, digital or printed, social networks, website and other communication channels of the hotel group without time limit and without the right to financial compensation.

PERSONAL DATA PROTECTION

In accordance with Regulation (EU) 2016/679 and Organic Law 3/2018, the personal data of participants will be processed for the purpose of managing the draw and delivering the prize. Interested parties may exercise their rights of access, rectification, deletion and other rights recognized in current regulations by sending an email to protecciondatos@grupoq.net

DISQUALIFICATION AND RESPONSIBILITY

Participants will be disqualified if they:

•           Do not meet the requirements indicated in these rules.

•           Use fake or fraudulent profiles.

•           Carry out any activity that could be considered fraudulent or that violates the good faith of the contest.

•            Do not own the intellectual property rights to the image.

ANDAMAN CLASSIC SL reserves the right to cancel the draw in the event of force majeure or circumstances that justify it.

ACCEPTANCE OF THE RULES

Participation in the draw implies full acceptance of these legal terms and conditions. ANDAMAN CLASSIC SL reserves the right to modify the terms and conditions if necessary, and undertakes to give due publicity to any changes.
